Overview
What is Auto Expungement?
Auto-Expungement is defined as the removal of information related to criminal activity. In this case, it is the removal of discretion of the Department of Justice or the Superior Court to object to or deny a petition for expungement for marijuana offenses in the United States Virgin Islands.
Criminal records prevent Virgin Islanders from securing gainful employment, housing, and education. Record clearing is the most powerful tool to eliminate these collateral consequences. Authorized by Act 8679 – to establish an auto-expungement process for individuals convicted of 19 V.I.C. § 607(a) violations – Simple Possession of Marijuana.

Who is Eligible:
Individuals convicted of 19V.I.C. § 607(a) violations – Simple Possession of Marijuana with two ounces or less.
How to Get Records Expunged?
Option 1: Self Expungement
Click “Expungement Petition” button. Complete form.
Submit Petition with supporting documents to the Superior Court of the Virgin Islands at vicourts.org
Option 2: Use Firm
The names of any firms willing to assist with expungements on a free or lowered fee basis will be added here as they are available.
Option 3: Hire Attorney
Hire a private attorney to submit petition on your behalf. You may find a list of attorneys at Virgin Islands Bar Association website
Possible Fees Associated with Expungement:
- Certified VIPD Background Check: $12
- Certified VIPD Arrest Reports: $10 each
- Certified Court Documents: $10 each (i.e., final judgment, satisfactory discharge of probation)
- Copies of Charging Documents: $3 each
- Court Filing Fee: $75
- Process Server: $100 (to serve the Department of Justice & the Government)
